1.    General
 
1.1    The General Terms and Conditions (hereinafter referred to as GTC) apply to all legal transactions conducted through our online store www.shop.schweizervideo.ch or
       are concluded in our Swiss AG Shop.
 
1.2    These General Terms and Conditions govern the relationship between Schweizer AG, Professional Video Technology (hereinafter referred to as Schweizer AG) and
.
       the customer (hereinafter referred to as customer(s)). These GTC are part of every contract between Schweizer AG and the customer.
       All offers, deliveries and services of Schweizer AG are exclusively based on these general terms and conditions.
 
1.3    With the order of the goods or the receipt of the goods, these terms and conditions are considered accepted, unless otherwise agreed in writing.

1.4    Terms and conditions of the customer do not apply, unless they have been expressly accepted in writing by Schweizer AG and are not in the
       contradiction to the terms and conditions of Schweizer AG.
 
1.5    These terms and conditions may be modified or revoked at any time by informing the customer accordingly.
 
2.      Offer
 
2.1    Our offers are directed exclusively to adult, commercial customers, self-employed persons and freelancers.
 
2.2    The offers on our webshop (www.shop.schweizervideo.ch) are subject to change and not to be understood as a binding offer.
       An order (purchase contract) is concluded as soon as the customer places his order in the online store, in the store, by phone or e-mail (also called "order") and by us  receives the order confirmation by e-mail or by the delivery of the ordered goods.
 
 
2.3    Schweizer AG does not guarantee the availability of the goods, whether based on offers or the publication of price lists, unless

2.4    Unless otherwise expressly stated in writing, offers of Schweizer AG may be withdrawn at any time prior to their unconditional acceptance.
 
2.5    All product details, product photos, specifications, accessory relationships, etc. that can be seen on our web store are provided without warranty.

3.    Prices
 
3.1    Subject to any written provisions to the contrary, the prices quoted and the offers submitted by Schweizer AG shall have a validity of

       15 days. All prices, products, merchandise descriptions, specifications and availability are subject to change at any time without notice to you
.
       subject to change.
 
3.2    Our prices are shown net (excl. VAT) in CHF or EUR, unless otherwise mentioned.
 
3.3    All additional costs, such as costs for packaging, disposal, freight, insurance, export, transit, import and other permits and certifications,

       shall be borne by the Purchaser. Also the orderer has to bear all kinds of taxes, charges, (disposal) fees and customs duties.
 
3.4    The sales price does not include consulting and support services.
 
3.5    The time of the order applies to the price determination. Subsequent price fluctuations during the execution of the order will not be taken into account.

3.6    Schweizer AG may make price changes at any time without notice.
 
4.    Means of payment and payment conditions
4.1    The clientele can use the payment options offered as means of payment in the online store under "Payment options"
.  
4.2    For new customers, the payment of the products is valid only against prepayment, credit card or upon collection in our store in cash, EC, Twint or Postcard.
.  
4.3    When purchasing on prepayment, the proforma invoice must be paid with a due date of 5 calendar days, otherwise Schweizer AG may cancel the order.
.  
4.4    If an item has to be ordered separately, Schweizer AG can also claim the advance payment in case of pickup in the store.
 
4.5    A purchase on account is only possible for customers known to us or against a credit check.
 
4.6    In case of chargeable purchase on account, the clientele is obliged to pay the invoice amount within 15 calendar days (or as agreed) after receipt of the
       delivery 
without any (discount) deduction to settle.
5.    Late payment and retention of title
5.1    If the clientele fails to meet its payment obligations in whole or in part, all  outstanding amounts owed by the clientele to Schweizer AG shall
       immediately due and Schweizer AG can claim them immediately. In addition, it can stop all deliveries of products to the clientele without further reminder,
.
       until the entire debt is settled.
 
5.2    Schweizer AG charges a handling fee of CHF 15.- (reminder fees) for the 2nd reminder and for the 3rd reminder a default interest of 5% is added
.
       (chargeable time since receipt of the first reminder or payment reminder).
 
5.3    If the customer does not comply with his debt settlement even after the set grace period, Schweizer AG may claim damages and, according to the
       provisions of the Swiss Code of Obligations (OR).
       In addition, the Swiss AG has the right to assign outstanding debts to external collection companies.
 
5.4    Until full payment of the purchase price (including additional costs), the delivered products remain the property of Schweizer AG.
       Thus, the customer is obliged to treat the delivered products carefully as long as they are in the property of Schweizer AG.

5.5    Schweizer AG is entitled to make an entry in the retention of title register.
 
6.    Deliveries and partial deliveries
6.1    The ordered products can be picked up either in the Swiss AG Shop to the whole Switzerland and Principality of Liechtenstein or to a
       foreign address can be shipped.
 
6.2    Delivery from Swiss AG is made by the post office or third parties. In principle, only delivered to the curb. The current prices are on

       www.schweizervideo.ch evident. Prices are subject to change without notice.  Items in stock are usually shipped within 48 hours.
 
6.3    If the customer wishes a partial delivery, he must explicitly inform Schweizer AG. The transport costs will be invoiced per delivery.

6.4    If the customer, when selecting "Pick-up at  Schweizer AG Shop", does not pick up the ordered products within 15 calendar days since they are ready for pick-up at the branch

7.    Testing obligation
7.1    The clientele shall immediately inspect delivered or collected products for correctness, completeness and delivery damage.

8.    Returns and exchanges
8.1    There is usually no right of return.
 
8.2    Only in some exceptional cases the return of delivered goods is possible. However, a return must always be agreed in advance by Schweizer AG.

8.3    The return of the goods must be in its original packaging, complete with all accessories and accompanied by the sales receipt. It is at the expense and risk of the customer.

8.4    Should the return not be complete or the original packaging show damage, Schweizer AG reserves the right to return the shipment or

       charge you a contribution towards expenses of 10% of the value of the goods, at least Fr. 75. -, for the arising Umtriebe as well as incurred postage or freight charges to charge.
 
8.5    Unauthorized returns, as well as items marked with prices or damaged on the way back due to insufficient packaging, will be returned to the sender

8.6    In the event that, the product can be returned, the refund will be made in the form of a credit or by bank transfer upon receipt of the goods.
9.    Warranty terms
9.1    The warranty conditions (in particular also the warranty period) of the manufacturer are authoritative for the articles purchased from Schweizer AG
       (is usually 12 months). Detailed information can be found in the manufacturer's specifications and the warranty certificate.

9.2    The delivery bill or invoice shall be deemed to be a warranty certificate and shall thus be kept carefully.
 
9.3    The customer acknowledges that the warranty provisions of the manufacturer usually only a right to rectification or replacement (replacement delivery)

9.6    The decision about repair or replacement of a device usually lies with the manufacturer. When replacing a device does not renew the warranty period.

       Home service is not part of the warranty. The replaced device or parts become the property of the manufacturer.
       There are no other or further warranty claims. Deviating provisions of the product manufacturer remain reserved.

9.7    Warranty replacement or warranty repair will not result in an extension of the original warranty period.
 
10.    Repairs
10.1  The cost of any repair outside the warranty shall be borne by the customer.
 
10.2  In the event of a reason for exclusion, a cost estimate will be provided, which will cover the testing costs and in the case of disposal or not repairing

10.3  Schweizer AG has no influence on the repair time.

10.4  Data loss may occur when repairs are carried out. Schweizer AG assumes no liability for the backup of an existing

10.5  The repair centers usually provide 3 months warranty on the work performed as well as the replaced parts.
       The warranty period starts from the date of delivery of the device by the repair center.
 
11.    Intellectual property
11.1  Schweizer AG reserves all rights for every design, texts and graphics on its websites (homepages), especially property rights and copyrights.
       The written consent of Schweizer AG, Schlieren is required before passing on to third parties.
 
12.    Rental

12.1  Property protection: the rental equipment with all its components remains the property of the lessor. A pledge, transfer by way of security, sale or transfer
.        of the rental property, is expressly not permitted. Lessee shall also bear any costs incurred by Lessor in the event of equipment failure due to late
       or damaged return.

12.2  Offer/Reservation Confirmation: The presentation of the rental equipment on the website does not constitute a legally binding offer, but a request for booking inquiry

       The order is always confirmed with a rental delivery bill (rental agreement), which shows which material is rented, when the pick-up time and return date is,
       as well as the price and payment terms of the rental. The person receiving the material confirms with his signature that all data in the delivery bill is correct
       and that he agrees with this contract.

12.3  Cancellation: Bookings can be cancelled free of charge up to 24 hours before the pick-up day. If a cancellation is made only after that time, we must pay a cancellation
.        fee of a fair CHF 15.00 retained. Cancellation request please always send with the order number by email.

12.4  Notices of Defects/Duties of the Lessee: The Lessee shall inspect the rented items immediately upon receipt for completeness, functional capability and flawless condition

       date returned in perfect condition

12.5  Liability: Lessee shall be liable for any damage arising as a result of negligence, gross negligence or theft.  Likewise, the tenant is liable for damages caused by
.        improper packaging, return transport or culpably delayed return/return. The lessee is liable for lost accessories and
.        the rental equipment itself, at the price of replacement.

12.6  Insurance: The rental equipment is insured only if the tenant has expressly ordered the equipment insurance and the insurance and the insurance-
.        conditions 
are part of the rental agreement. If the optional insurance is not booked, the renter is liable up to the full amount of the replacement value

12. 7  Transfer of risk: The risk passes to the tenant as soon as he leaves the premises of the landlord or receives the package from the parcel service provider. In the

13.    Privacy

13.1  Schweizer AG guarantees that customer data brought to our attention in the course of an order will be treated confidentially and not passed on to third parties.
       For the personal data Schweizer AG assures that all data is observed according to the data protection act and the relevant legal norm.
 
13.2  Should individual provisions of these GTC be invalid or ineffective, this shall not affect the validity of the remaining provisions and these

       GTC as a whole.
 
14.    Place of performance, jurisdiction and applicable law
14.1  All legal relations between Schweizer AG and the customer are subject to Swiss law. The place of jurisdiction for all disputes
.
       shall be the registered office of Schweizer AG.
 
15.    Final provisions
15.1  Should individual provisions or several provisions of these GTC be wholly or partially invalid or later lose their legal effectiveness,
       this does not affect the legal validity of the remaining terms and conditions.
